Terms of Service

Agreement

This shop is operated by VARO Industries, doing business as The New Janky Workshop (“we,” “us”). By placing an order or downloading a file from this site, you agree to these terms. If you do not agree with them, please do not use the shop.

Products and Pricing

Everything here is made or designed by hand. Physical items are one-off or small-batch, so grain, color, and finish vary from piece to piece — photos are representative, not exact. We do our best to keep prices, descriptions, and availability accurate, but we may correct errors and change or discontinue any product at any time. If we cancel an order because of a pricing or stock error, you get a full refund.

All prices are in US dollars.

Orders and Payment

Payment is processed by Stripe at checkout. An order is not accepted until payment clears. We may refuse or cancel any order — for example if we suspect fraud, or if we simply cannot make the item — and we will refund you in full if we do.

Shipping

Handmade items ship from South Attleboro, Massachusetts, and are typically built to order, so allow time for the build before it ships; the product page tells you what to expect. Printed apparel is made to order by our print partner and ships from whichever of their facilities is closest to you, which means an order containing both may arrive in more than one package. Once a package is handed to the carrier, delivery timing is up to them.

Risk of loss passes to you on delivery to the carrier, but if a package is lost or arrives damaged, tell us and we will help sort it out.

Returns on Physical Items

If something arrives damaged or is not what you ordered, email tnjw@duck.com within 14 days of delivery with photos and we will repair, replace, or refund it.

Unused, undamaged stock items may be returned within 14 days of delivery for a refund of the item price; return shipping is on you. Custom and made-to-order pieces are not returnable unless they arrive faulty.

Digital Downloads

Digital products — plans, templates, SVG and CNC files — are delivered as a download link emailed to you after purchase. That link is personal to you and expires; do not share it.

Because digital files are delivered immediately and cannot be returned, all digital sales are final. If a file is corrupt, missing, or does not match its description, email us and we will fix it or refund you.

License to Use Our Files

When you buy or download a digital file, we grant you a non-exclusive, non-transferable license. You may:

  • Use the files for your own personal or hobby projects.
  • Make physical items from the files and sell those finished physical items, including at markets and online.

You may not:

  • Share, resell, sublicense, give away, or publicly post the files themselves, in original or modified form.
  • Include the files in a bundle, course, template pack, or membership site.
  • Mass-produce items from the files under a separate brand as if the design were your own, or claim the design as your own work.

We keep all copyright and other rights in the files. Free downloads carry exactly the same license as paid ones.

Build at Your Own Risk

Our plans, templates, and videos involve power tools, sharp edges, lasers, CNC machines, and heat. They are provided for informational purposes as-is, with no warranty that they are complete, accurate, or suitable for your machine, materials, or skill level. You are responsible for working safely, following your equipment's instructions, and complying with local rules. To the fullest extent the law allows, we are not liable for injury, property damage, or loss arising from use of our files, plans, or content.

Site Content

The text, photos, videos, logos, and designs on this site belong to us and may not be copied or reused without permission. You agree not to scrape the site, interfere with its operation, or use it for anything unlawful.

Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim relating to a product or to this site is limited to the amount you paid for the product in question. We are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot legally be limited.

Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, and any dispute will be handled in the courts of Massachusetts.

Changes and Contact

We may update these terms; the date at the top of this page shows the current version, and the terms in effect when you ordered are the ones that apply to that order. Questions go to tnjw@duck.com.
